Nevertheless, even in such an “unusual” situation, more and more couples continued to live in a civil marriage — together, but without officially registering their relationship with the Civil Registry Office. After all, everyone already knows that they are husband and wife, that they have children and joint property — so is it worth spending money on some “official papers”?
Of course, this is understandable logic, but it has its drawbacks, the legal website writes.

The fact is that from a legal point of view, only a union registered with a state civil registry office is considered a marriage. And if a couple lives together without such registration, their relationship does not create the legal status of a spouse.
This means that for the state they are not husband and wife in the legal sense, and therefore the benefits provided for official marriages do not apply to them.
And since the Tax Code of Ukraine clearly defines the list of income that is not subject to taxation (Article 165 of the Tax Code of Ukraine), money transfers between persons who are not in a registered marriage are not included in this list.

Therefore, if one partner in a civil marriage sends money to the other, it is considered taxable income. The general rules apply to such funds:
18% — personal income tax (PIT);
5% is military duty.
If the transfer is made by an individual who is not a tax agent (i.e. not an individual entrepreneur, not a legal entity, and not an independent professional), then the obligation to declare this income falls on the recipient.
This means that a person must:
- Include the funds received in your annual tax return.
- Submit a declaration to the tax office.
- Pay the required taxes within the established deadlines.
That is, the situation should somehow encourage people to either fix the relationship at the official level, or not “fool” others about their responsibilities. Of course, women usually benefit from this (although this is not certain)).
