On Wednesday, the Government Legislation Centre (RCL) published a draft amendment to the act on the mObywatel application and certain other acts. Among other things, the teacher's mLegitymacja will be added to the application.
The new regulations will enable the user of the mObywatel application, in addition to the current possibility of presenting their document in electronic form, to additionally deal with official matters by submitting signed applications or letters.
In addition, the application will be equipped with a virtual assistant function based on an artificial intelligence model that does not use the user’s personal data.
Changes are also planned in the legal basis for issuing students and teachers with ID cards in the form of a mobile document – mLegitymacja, among other things, in order to refrain from issuing mLegitymacja to teachers employed in Polish schools and schools and school complexes at diplomatic missions, consular offices and military missions of the Republic of Poland. In the justification, the authors of the bill wrote that currently teachers employed in Polish schools and schools abroad are entitled to receive a teacher's service ID in the form of an ID-1 format card. The mObywatel Act of 2023 provided that mLegitymacja would also be issued to teachers from these schools, but this solution has not yet entered into force. Other teachers will be issued an electronic ID card.
In addition, electronic versions of the ID will also be issued to students. The school mLegitymacja will be available to adult students and those under the age of majority whose parents have not expressed objection.
The physical version of the ID card – for both the teacher and the student – will be issued at the request of the authorized person.
In addition, the provisions governing the provisions on teacher service ID cards will be supplemented with issues concerning schools keeping records of blank ID cards and personalized records of issued ID cards.
It will also be possible to store and archive data or electronic documents in the mObywatel system that are necessary to provide services in the application for the period required to perform them. The authors of the project stated in the justification that “the introduced change will enable secure storage of data in the mObywatel system and ensure the possibility of their recovery”.
The set of tools enabling cryptographic verification of mobile documents, which are supported as part of the services provided in the mObywatel application, will also be expanded to include an internet service.
In addition, the amendment will enable the Minister of Digital Affairs to provide a tool that allows for the possibility of signing an electronic document with three types of electronic signatures. In addition to the existing trusted signature, these are to be: a qualified electronic signature and a personal signature. (PAP)
