Judge rejects Musk's motion to block OpenAI from becoming a for-profit company

A US federal judge has rejected Elon Musk's request to stop OpenAI from becoming a commercial entity.

However, the judge indicated that she could expedite the process to hear Mr. Musk's claims against the ChatGPT developer and its CEO.

US District Judge Yvonne Gonzalez Rogers said Mr Musk “failed to demonstrate a likelihood of success on the merits” in his motion for a preliminary injunction.

She proposed holding the trial in her California courtroom this fall, “given the importance of the public interest and the potential harm that could result from an unlawful appeal.”

Mr Musk, an early investor in OpenAI, launched legal action against ChatGPT creator and CEO Sam Altman a year ago, suing for breach of contract, arguing it was a betrayal of the non-profit's core goals.

Late last year, he escalated the legal battle, adding new lawsuits and defendants, including Microsoft, and seeking a court order that would stop OpenAI from becoming a for-profit company.

Mr Musk also included his artificial intelligence company xAI as a plaintiff, arguing that OpenAI is unfairly stifling competition in the industry.

He and a group of investors recently submitted an unsolicited $97.4 billion offer to acquire a controlling stake in the nonprofit, a move that undermined Mr. Musk's “claim of irreparable harm,” the judge said.

OpenAI said it welcomed the court's decision.

“This was always about competition,” the company said. “Elon’s own emails show that he wanted to merge commercial OpenAI with Tesla. This would have been beneficial to his personal interests, but not to our mission or the interests of the United States.”
