In what cases can a pensioner request a recalculation of payments: three reasons for contacting the Pension Fund

Ukrainian pension legislation provides for several cases when pensioners are repaid. Some of the recalculations are carried out automatically. This includes, in particular, an increase in the subsistence minimum for persons who have lost their ability to work.

As specified on the portal uristy.ua, for people who have taken a well-deserved rest and are no longer working, the recalculation is carried out automatically – from the day the new subsistence minimum is established. And for working pensioners – from the day of dismissal or termination of employment.

The second reason is an increase in the salary of a working pensioner, if after the appointment of an old-age or disability pension, the person received a higher salary for more than two years than the one on which the pension was calculated.

“This also applies to the minimum pension, if it was assigned due to the lack of insurance experience at the time of registration. Pension recalculation can be done once every two years. That is, if the pensioner's earnings continue to grow, he has the right to resubmit an application for the amount to be transferred. But it can be done no earlier than two years after the previous one,” lawyer Yuriy Ayvazyan clarified.

The third reason is the acquisition of additional work experience. For example, if a person retired with incomplete insurance experience and continued to work, then every two years of work they can recalculate their pension taking into account the new experience.

“However, if a person continues to work after retirement and gains sufficient experience to be granted a full pension, then the recalculation can be carried out immediately. There is no need to wait two years after the last recalculation,” the specialist added.

The reasons for pension recalculation may also be:

  • provision by the pensioner of documents on length of service or earnings that were not taken into account when calculating the pension;
  • establishing allowances, promotions, supplements, etc. For example, this applies to people who receive military pensions, pensions for special merit, as well as the honorary titles of “merited” or “people's”, etc.;
  • promotion at the request of a combatant;
  • loss of a breadwinner, etc.
