The government is working on regulations on pay transparency. Among the planned changes are the disclosure of salary ranges for candidates and reporting the pay gap between women and men. The new regulations are the result of an EU directive and are to see the light of day in the coming months.

Michał Lisawa, partner and expert in employment law at Baker McKenzie, emphasizes that according to the new requirements, job candidates should know the offered salary before the recruitment interview. Employers will be obliged to pay equal wages for identical work or work of equivalent value. Employees will be able to ask about the average salary in a group of employees performing work of equal value, e.g. in a given position, which is to increase transparency and contribute to reducing the gender pay gap in the workplace. However, they will not be able to know the salary of specific individuals, which is intended to protect employee privacy.

There is also a significant change in the regulations on mobbing. Currently, in many cases concerning mobbing before Polish courts, employees encounter difficulties in effectively pursuing their rights due to complicated statutory requirements. The Ministry of Family, Labor and Social Policy has presented a draft act that provides for simplifying the definition of mobbing and lowering legal barriers for employees. The new regulations are intended not only to protect people affected by mobbing, but also to prevent it by strengthening the obligations of employers in the field of constant and regular counteracting mobbing. Thanks to this, employees are to be better informed about their rights, and employers more motivated to take actions that create a safe and friendly working environment – sums up Michał Lisawa.
