The Trump government submitted an urgent request for a stay on Friday to the Supreme Court to overturn a judicial ruling from a lower level that was obstructing the assignment of the National Guard in Chicago.
"This Tribunal should suspend the district court’s injunction from October 9 in its full capacity," the document, authored by Solicitor General John Sauer, stated.
Sauer contended that the order "encroaches upon the President’s jurisdiction and unnecessarily puts at risk national personnel and property."

He expressed that the Supreme Court should intervene presently "so the National Guard can execute its protection role as further litigation persists. Considering the immediate threat of aggression, this Tribunal must also issue an immediate administrative delay while the present application is under deliberation."
On Thursday, a panel of three judges from the 7th Circuit Court of Appeals declared the Trump administration's choice to send National Guard forces was a "likely breach" of the Tenth Amendment, which allocates certain authorities to the states.
The panel, which encompasses a judge designated by Trump, and presidents George W. Bush and Barack Obama, similarly deduced that the Trump government was "not likely to prevail" in substantiating that there is a "revolt" against the power of the U.S. government or that the president lacks the capability to enforce the law via customary forces.

A provisional directive halting the deployment of the Guard is still valid until Oct. 23. U.S. District Judge April Perry has slated a session for Oct. 22 to ascertain whether to prolong the temporary ruling.
As of the past week, approximately 200 federalized National Guard members from Texas and 14 from California were in Illinois, according to a statement from an official from the U.S. Army. The president mobilized an additional 300 Guardsmen from Illinois over the opposition of Gov. JB Pritzker.
President Donald Trump has communicated that Guard troops are essential for crime deterrence in Chicago, which he has characterized as a "battle zone."
