Trump Claims Right to Intervene in Comey Matter, but DOJ Holds Indictment Power

On Thursday, President Donald Trump commented that he could “get involved if I desire” regarding whether his Justice Department should pursue charges against past FBI Director James Comey, yet is deferring that judgment to officials at the DOJ.

Sources informed ABC News that the freshly appointed U.S. attorney for the Eastern District of Virginia, Lindsey Halligan, intends to request a grand jury in the next few days to indict Comey for supposedly misleading Congress — despite prior conclusions by prosecutors and investigators that there wasn’t enough proof to file charges.

Trump was prompted to give his thoughts on the topic during a meeting with the President of Turkey, Recep Tayyip Erdogan, in the Oval Office.

“Well, I cannot predict what will unfold because I’m uncertain,” Trump stated.

Trump mentioned that Halligan, whom he personally selected for the position after Erik Siebert stepped down amid pressure to bring allegations against New York Attorney General Letitia James, along with Attorney General Pam Bondi and Deputy Attorney General Todd Blanche will be the ones reaching the determination.

“I am not making that decision,” Trump affirmed. “While I believe I’d be within my rights to get involved if I wished, I’m opting not to. I will simply say that Comey is a reprehensible individual. He's a deranged person. I believe he’s a truly disturbed guy. His actions at the FBI were egregious. And — but I don’t have any clue. I’m in the dark as to what’s going to transpire.”

Comey has been a consistent target of Trump’s critiques due to his investigation regarding Russian meddling during the 2016 election.

Trump relieved Comey of his duties in 2017 and has frequently requested prosecutions pertaining to the Russia investigation, which he has dismissed as a “hoax.”

Over the course of the weekend, Trump addressed a message to Attorney General Bondi expressing his dissatisfaction with the perceived lack of action against Comey, in addition to Democratic Sen. Adam Schiff from California and James from New York.

“We cannot afford to wait any longer; it is tarnishing both our standing and believability,” Trump conveyed within a post featured on his social media platform. "They initiated impeachment proceedings against me twice, and I have been indicted (5 times!), FOR ABSOLUTELY NOTHING. JUSTICE MUST PREVAIL, IMMEDIATELY!!!"

The five-year limit for legal action against Comey for allegedly giving misleading statements on Sept. 30, 2020, will expire this upcoming Tuesday, Sept. 30, 2025.
