The employer will be obliged to provide the candidate for the position with information about the proposed remuneration in advance in order to enable informed and transparent negotiations – President Andrzej Duda signed an amendment to the Labor Code on the transparency of wages on Wednesday.

The purpose of the amendment to the Labor Code is to introduce an obligation for employers to include information in job advertisements about the proposed remuneration that they plan to offer to candidates applying for a given position. The changes are intended to increase the transparency of remuneration, strengthen equality and counteract discrimination in the recruitment process, as well as better protect the privacy of job candidates.

The amendment imposes on the employer the obligation to provide the job candidate with information regarding: the proposed remuneration (including all its components), its initial amount or remuneration range – determined on the basis of objective and neutral criteria, in particular taking into account gender equality.

Information on salary will be presented to the candidate for the position in the recruitment announcement; before the interview, if the employer has not announced a recruitment for the position or has not provided this information in the announcement; before the establishment of an employment relationship, if the employer has not announced a recruitment for the position or has not provided this information in the announcement or before the interview.

The employer will be required to provide the above information in paper or electronic form – sufficiently in advance to allow the candidate to familiarize themselves with it. The purpose of this solution is to enable the person applying for employment to conduct informed and transparent negotiations.

The employer will also be obliged to ensure that job advertisements and job titles are gender-neutral and that the recruitment process is non-discriminatory.

In addition, the employer will not be able to request that a job candidate provide information about remuneration in the current employment relationship or in previous employment relationships.

The Act will enter into force 6 months after its publication in the Journal of Laws. (PAP)
