Mr. Jerzy's studio apartment. The Council of the Notarial Chamber has spoken out

The Council of the Notary Chamber in Gdańsk found no formal irregularities in the notarial deeds drawn up by notaries as part of the transaction of purchasing Jerzy Ż.'s studio apartment – the RIN spokesman reported. According to the statement, the responsibility for the truthfulness of the declarations submitted by the parties rests with the persons submitting them.

On Friday, a meeting of the Notarial Chamber in Gdańsk was held, during which the Gdańsk City Hall requested an analysis of the case of the takeover of Jerzy Ż.’s studio apartment by Karol Nawrocki in terms of a possible violation of the principles of notarial ethics.

On Friday evening, the spokesman for the Chamber, Sławomir Wroński, sent PAP a statement from the Council of the Notary Chamber in Gdańsk. The letter states that on Friday, the RIN “carried out a thorough analysis of the content of notarial deeds concerning the purchase of a residential premises by Mr. Karol Nawrocki. As a result of the verification of documents and the conversation regarding the circumstances of their preparation, the RIN in Gdańsk did not find any formal irregularities in the notarial deeds prepared by notaries as part of the transaction in question” – we read in the document.

At the same time, the Council stated that the notary draws up notarial deeds based on declarations submitted by the parties to the notarial deed, referring to the submitted documents, and does not have any legal basis or tools to verify the truthfulness of the declarations.

The RIN announcement noted that performing notarial acts outside the notary office is legally permissible. The Council also emphasized that the responsibility for the truthfulness of the declarations submitted by the parties rests with the persons who submit them.

The case of the apartment of the presidential candidate supported by PiS is the result of a publication by the Onet portal, which revealed that – contrary to his earlier declaration – Nawrocki does not own one, but two apartments. In addition to the apartment in Gdańsk, where he lives with his family, he also owns a studio apartment. As the candidate himself and his team explained, he took it over from an older man in exchange for care; however, Jerzy Ż. ended up in a social welfare home.

Nawrocki stressed that he had nothing to reproach himself for in this matter and that he had been helping Jerzy Ż. selflessly for years. PiS showed a notarial deed, according to which Nawrocki was to pay PLN 120,000 for the studio apartment. Nawrocki said, however, that he made the payment by giving Jerzy Ż. “specific financial resources over the course of 14 years”, and finally informed that he would donate the apartment to charity.
