Appeals court upholds bar on Illinois National Guard deployment, allows mobilization.

A U.S. appeals court is upholding a hold on the Trump administration from using federalized National Guard forces in any locale inside the state of Illinois, while still permitting the federal authority to retain command of the states' Guard forces.

The ruling from the 7th Circuit Court of Appeals was issued as it approved a partial pause Saturday of a judgment by a lower court that had been appealed by the Trump administration.

On Thursday, U.S. District Judge April Perry gave a temporary restraining order, preventing the utilization of National Guard forces from any U.S. state within Illinois.

"While awaiting a determination on the request for a pause while the appeal is ongoing, the district court’s October 9, 2025, mandate is briefly HALTED only to the degree that it restrained the federalization of the National Guard of the United States inside Illinois," the circuit court mandated. "National Guard personnel are not obligated to go back to their home states unless a court orders them to do so subsequently."

In total, roughly 200 federalized National Guard forces from Texas and 14 originating from California are presently situated in Illinois, according to an announcement from a U.S. Army representative. A further 300 Guardsmen coming from Illinois have been mobilized by the president, despite the objections of Gov. JB Pritzker.

Attorney General Kwame Raoul referred to the court’s ruling as "a win for our state."

"This represents a triumph for state and local law enforcement — who possess awareness of their communities and defend the entitlement of their communities to honestly express their opinions to positions of authority," he declared in a public statement.

The 7th Circuit's decision regarding National Guard personnel in Chicago happened one week after another federal judge impeded the deployment of the National Guard in Portland, Oregon, and subsequently disallowed the entry of any state's National Guard into the city.

The Trump administration challenged the determination, and the Ninth Circuit Court of Appeals briefly revoked a ruling by a lower court that was hindering the use of Oregon National Guard forces in the city. 

Nonetheless, a more extensive mandate that forbids any state’s National Guard from being sent into Portland is still active.
