Some banks have begun to block social payments: why Ukrainians may be left without assistance

It seems that experts' warnings that banks will block even social payments on cards for utility debts or other not very significant reasons may turn out to be a nightmare reality for many Ukrainians.

And despite the fact that the law guarantees the inviolability of such funds, sometimes banks block access to money, creating real difficulties for families, writes “News.LIVE.”

The publication also explains that such cases occur when state enforcement officers submit requests or documents that the bank considers to be incorrectly executed. Formally, no one seizes the money, but the client is actually left without payments. This can affect anyone – a mother waiting for child support, a pensioner counting on assistance, or a student receiving a scholarship. As a result, you have to knock on the doorsteps of bank branches for months, contact the enforcement service and even write complaints to the National Bank.

This happened to one client of PrivatBank, the publication describes the case on the reviews page of the Ministry of Finance portal. The reason for blocking the accounts was the presence of an “error in the letters of the executor.” In other words, the institution deprived the mother and children of payments due to some mythical “errors in the letters.”

According to the woman, she handed over all the documents to the executor, received a certificate from the bank about the intended use of the funds, but never saw the money.

At the same time, the woman reminds that according to Article 73 of the Law “On Enforcement Proceedings”, child and other social benefits are not subject to seizure. There is also a resolution of the NBU No. 162, which obliges banks to provide access to funds after confirming their purpose.

Despite this, PrivatBank actually withholds social funds, although it has no right to do so.

The woman also appealed to the NBU with demands to check whether PrivatBank is operating legally and to oblige the institution to immediately restore access to the money. In addition, the Ukrainian woman wants to receive an official explanation from the bank regarding the blocking of money despite the norms of the law and the requirements of the NBU.

“A story like this is a signal for all Ukrainians. If you receive a notification about blocking social payments, know that this is not always legal. You need to immediately contact the bank with a written request, demand an official explanation, and if the answer is not satisfactory, complain to the NBU. It is important to have all the documents — certificates on the assignment of payments, decisions of executors, copies of applications,” says one of the bank’s client groups on the social network.

As a reminder, “FACTS” wrote that in July the CCS of the Supreme Court (the Civil Court of Cassation within the Supreme Court) made an important decision: in cases of financial fraud, the blame is not automatically shifted to cardholders, as was usually the case before. And banks must be responsible for the security of the services used by Ukrainians.
