The judge presiding over Harvey Weinstein's sexual assault trial has called an end to the latest rape charge after the jury foreman said he did not intend to continue deliberating.
Deliberations ended Thursday, a day after jurors returned a partial verdict in Weinstein's sex abuse case.
Jurors were unable to reach a verdict on a third charge, a rape allegation that occurred in 2013.
On Wednesday, the foreman expressed displeasure that another juror had insulted him and on Thursday said he would not return to the jury room.
The panel found the former studio head guilty on one charge but acquitted him on another. Both charges involved forcing women to perform oral sex in 2006. Those verdicts stand.
As the jury chairwoman later reported to the judge, the jury, consisting of seven women and five men, unanimously reached this decision last Friday.
The sentence was handed down Wednesday only because Judge Curtis Farber asked if there was agreement on any charges.
The third charge involved the rape of a woman who also claimed she had a consensual relationship with the Oscar-winning producer.
Under New York law, the charge of third-degree rape carries lesser penalties than the other two charges.
Weinstein denies all charges against him.
