The National Broadcasting Council announced on Monday that the Court of Appeal in Warsaw confirmed the validity of the imposition of a fine of PLN 80,000 by the Chairman of the National Broadcasting Council on TVN S.A. for interrupting the “Fakty” news service broadcast on June 23, 2023 with an advertisement.
In October 2023, as a result of ex officio proceedings, the Chairman of the National Broadcasting Council decided to penalize the TVN station for interrupting the “Fakty” news service broadcast on June 23, 2023 with an advertisement.
In a press release sent to PAP, the National Broadcasting Council informed that the Court of Appeal in Warsaw confirmed the validity of the imposition of a fine by the Chairman of the National Broadcasting Council on TVN SA. The judgment of the Court of Appeal of May 23, 2025 concerns the appeal of TVN SA against the decision of the Chairman of the National Broadcasting Council to impose a fine of PLN 80,000 for violating art. 16 sec. 6 item 1 of the Broadcasting Act, i.e. interrupting the “Fakty” news service with an advertisement. It was noted that at the same time, the Court of Appeal in Warsaw ordered the Chairman of the National Broadcasting Council to pay PLN 5,400 as reimbursement of the costs of legal representation in the first instance and PLN 4,050 as reimbursement of the costs of legal representation in the appellate proceedings. The judgment is final.
In a position sent to PAP by the TVN Warner Bros. Discovery Press Office, it was indicated that “the temporary and one-time interruption of the news program resulted from a technical error and not an intentional action , which is why from the beginning we did not agree with the basis for the imposition of the penalty by the National Broadcasting Council”. “After reviewing the written ruling of the Court of Appeal, we will make a decision regarding further legal steps” – it was noted?
In accordance with art. 53 sec. 1 of the Act, if a broadcaster violates the obligation resulting from, among others, the provisions of art. 16a of the Act, the Chairman of the National Council issues a decision imposing on the broadcaster a fine of up to 50 percent of the annual fee for the right to use the frequency intended for distributing the program via terrestrial broadcasting.
