US judge to decide whether Menendez brothers deserve lighter sentences

Erik and Lyle Menendez could find out this week whether they will receive reduced sentences — and a chance at freedom — nearly 30 years after they were convicted of killing their parents.

A Los Angeles judge will preside over a resentencing hearing expected to last two days beginning Thursday.

The judge may make a decision at the hearing or provide a written verdict later.

If the judge reduces their sentences, the brothers will still need approval from the state parole board to leave prison.

The district attorney's office filed a motion Wednesday evening to delay the resentencing hearing so prosecutors can get a full risk assessment from the state parole board.

California Governor Gavin Newsom ordered the assessment in February, and a final hearing on the brothers' risk assessment is scheduled for June 13.

In their statement, prosecutors noted that the parole board had already completed its reports.

In 1996, the brothers were sentenced to life in prison without parole for the murder of their father, entertainment industry executive Jose Menendez, and mother, Kitty Menendez, in their Beverly Hills home in 1989.

At the time of the murder, the brothers were 18 and 21 years old.

Defense attorneys argued the brothers acted in self-defense after years of sexual abuse by their father, while prosecutors said they killed their parents for a multimillion-dollar inheritance.

The case has been of public interest for decades, and the Netflix drama Monsters: The Story of Lyle and Erik Menendez and the documentary The Menendez Brothers have brought it new attention.
